In this "Emergency Phase" of trade secret misappropriation: securing Temporary Restraining Orders (TROs) and Preliminary Injunctions to stop the bleeding before the damage is permanent is critical.
A Trade Secret TRO is a "legal fire extinguisher." If we can move immediately to federal or state court to seek ex parte relief (orders granted without the other side present) to freeze the data thus legally barring the defendant from using, sharing, or destroying stolen proprietary information, that would be ideal for you. Emergency TRO's can also mandate forensic imaging, by securing court-ordered access to personal devices and cloud accounts to preserve a digital "chain of custody." Moreover the Order can enforce the "Cordon Sanitaire" by preventing the former employee from starting work at a competitor until a forensic audit confirms no contamination of the new employer systems.

Not every departing employee is a thief, and not every spreadsheet is a trade secret. Depending on the party the Firm represents, the "Reasonable Particularity Challenge, under 2026 standards (like the NEXT Payment Solutions doctrine) may be of consequence and we want to force parties to define their "secret" with technical precision. If they can't describe the "how" (the code) versus the "what" (the result), we will expect the case to die in the TRO Stage.

With respect to independent development defense, digital forensics can be applied to prove that your technology was developed through parallel research or public information and not misappropriation. If a company didn't encrypt their data or enforce NDA's, they can't claim trade secret protection.​​
POST-JUDGMENT MOTIONS TO RECONSIDER & APPEALS
If your business received an unfavorable judgment there are legal options to address what you might feel is an injustice. A Motion for Reconsideration or an Appeal might be in order. However, the deadlines immediately after such a judgment begin to require immediate attention.
